First argument: Marion Jones example
Marion Jones filed a $25 million lawsuit against Victor Conte—the founder of BALCO—for defamation of character. Jones would later plead guilty to lying to federal agents about taking banned substances.
Second argument: Poker analogy
Does using intimidation convince fans that you never took performance-enhancing drugs? In poker, you can bluff all you want, but it does not mean anything if your opponent calls and you have the lower hand. This may be the same in the case against Roger Clemens. You can sue all you want, but if there is some reliable evidence out there against you, it does no good to sue.
